Due to the variety of traditions and sayings since the time of the Prophet the issue of father's guardianship and their permission on a mature virgin daughter's marriage is a matter of concern. The above mentioned issue has been discussed and considered by religious scholars (Faghih) in many traditional books. Diligent research into History shows that there have been many controversies regarding such guardianship due to it's diversity. These controversies can be summed up in five catorgories. One of these five being the fact that a mature virgin daughter should be independent of her father and paternal grandfather in making decisions regarding her marriage, where as the civil code requires the consent and permission of the father or paternal grandfather regarding marriage. It seems that in most cases the law makers on the basis of Imamieh (Faghih) (religious scholars) consider the majority opinion to be in favor of the father's consent just for the well being of the girl and to prevent social problems. Legistlation believes that age factor is important in determining independant marriage. In this article the above mentioned issue (independence of a girl in marriage) with reference to Imamieh (Faghih) documents and Iranian Law is discussed.
