Arbitration is considered diverse in Iranian statute. Many arbitaratory organizations or institutions, such as the council of arbitration regarding the importance of family in Islam and the necessity of strengthening this holy family foundation have been established. Some councils are established to resolve family cases, but it seems some family laws, due to religious discrepancy over the divine law and the welfare of the family are not enacted, and has led to the intensification of family crisis .In addition to the above mentioned factors and the executive incompetency of such laws these councils have not been successful. Therefore it is necessary to review the present rules and regulations and legislate new laws in order to provide practical principles of arbitration.
The present article, while stating the legal principle of arbitration, the characteristics of arbitrators, and the extent of their jurisdiction in resolving family crisis addresses the performance of the arbitratory council to see whether it is doing it's duty according to the principle of arbitration. Finally it offers some suggestions for improving the relationship between couples so that they will have a successful marriage and to strenghthen the foundation of the family.
