حمایت کیفری از خانواده در قانون مجازات اسلامی

Due to the fundamental role of family in the society and its contribution to social life it has always been considered as one of the most important foundetion in society. Therefore all governments have taken serious steps in guarding, supporting and protecting the excistane of family life. Criminalization of actions which threaten the family is one of the steps that has been taken by governments.
Islamic criminal law addresses this basic social needs in a comprehensive and rational manner. This article maintains that the law makers regard the protection of family sanctity as important.
Law regarding punishernt which were ratified in 1375 is taken into consideration in Islamic criminal law.
Due to the diversity of penal law in support of the family, codification of a special chapter for crimes against family is necessary. Laws regarding remarriage without the consent of a court has to be modified. In addition move laws should be made to support the affected member of the family. Having carried out a comperative study of Iranian laws and International documents this paper attempts to criticize and analyse those possible area of conflict. Meanwhile suggestions have been made to improve the legal approaches.
