Feasibility Study of Adjusting and Deferring the Wife’s Financial Rights of in the Circumstances of Contagious Diseases in Light of Jurisprudential Rules

Abstract
 One of the fundamental challenges among the families in recent years, exacerbated by the spread of contagious diseases and reducing incomes alongside economic crises, is the possibility of adjusting and deferring the financial obligations and rights of spouses. Therefore, the aim of the present article is to explain the feasibility of limiting—adjusting—and deferring the the wife’s financial rights under secondary conditions from the perspective of jurisprudential and legal rules, utilizing a descriptive-analytical method. According to the research findings, economic pressure on family management and the increase in cases of abandonment of alimonies and dowries are among the most significant challenges facing families due to the outbreak of emerging and contagious diseases. From the standpoint of jurisprudence and law, if a contagious disease reaches a level that causes hardship and harm to the spouses, it is possible to adjust the terms of payment regarding the dowry and alimony based on the requirments of time and place, in accordance with the court judge's ruling. In such cases, it may be permissible to temporarily defer the ruling under specific conditions, while the fundamental financial obligations of the husband cannot be waived or altered, as all financial obligations are conditional on the husband’s ability and do not necessarily require the avoidance of hardship. Furthermore, the jurisprudential principles—specifically the secondary titles such as hardship— do not have the ability to restrict these obligations; rather, they are considered instances of debt.
