The Powers and Duties of the Prosecutor in Ensuring the Rights and Freedoms of Women Accused of not Wearing the Hijab to be naked

Abstract

The establishment of the prosecutor's office resulted from the existence of an institution that can be summarized in the protection of individual and social rights. The prosecutor, at the head of the public prosecutor's office, is responsible for important powers and duties, including monitoring the proper implementation of laws, prosecuting defendants, executing sentences, etc. His role is one of the most important, in addition to increasing the powers and duties of the prosecutor with the approval of the Criminal Procedure Law approved in 2012, in other regulations also in the cases of monitoring the judicial authorities and protecting the rights of the public, such as encountering with non- veil, without considering the control body and the guarantee of implementation is significant in its decision-making and performance, especially in social issues and challenges. In this descriptive-analytical research, while investigating the role of the prosecutor's duties and powers on the rights and freedoms of the eye in dealing with women who are not veiled, the existence of an independent and popular supervisory body over executive decisions in the current structural conditions such as the Islamic Consultative Assembly, the determination of the guarantee of strict and deterrent execution, increasing and improving the supervision and training of the officers, and drafting a comprehensive law to resolve the executive ambiguities have been suggested.
