The Possibility of Taking Back the Right of Alimony by the Wife from the Husband's Forbidden Property

Abstract

Alimony is one of the most important financial rights of the wife, and she obtains this right under the conditions of permanent marriage and full obedience. It has an important role in the Islamic legal system, so the wife's alimony is recognized prior to other causes of alimony’s obligation in Islam. And the alimony as the husband's present debt, plays a significant role in strengthening the family structure and achieving social justice. Considering this importance, the present study intends to investigate the possibility of receiving alimony by the wife from the husband's forbidden property, from a jurisprudential and legal point of view, while explaining the concept, causes of obligation, cases of wife’s alimony, as well as the forbidden earnings and the husband's acquisition. For this purpose, this research, due to the lack of verses and narratives in this subject, will examine the opinions of ancient and recent jurists and lawyers as well as Fatwas of Supreme Authorities. Meanwhile, this research which has been done by library-documentary method is a fundamental-applied research. The findings show that it is not permissible for the wife to receive and use the husband's forbidden property for alimony in normal and non-urgent conditions. In addition, the legitimacy of taking back such a right is only in the necessity conditions and subject to conditions like the existence of severe current or imminent danger; not- creating danger on purpose by the distressed; existence of proportionality between action by distressed and the danger, and the necessity of action by the distressed to avoid the danger. The results also revealed that the necessity mentioned in rule of Urgency (Ghaedeh-e-Ezterar) include all cases of wife’s alimony subject to the fulfillment of the conditions of necessity.
