Journal Article 2024 09 12 The issue of looking at a non-mahram is one of the important religious issues in the social arena, and knowledge of its Sharia ruling is very important for religious individuals. A woman ‘s gaze at a non-mahram man without lustful intent, like a man’s gaze at a non-mahram woman, is an issue that requires jurisprudential analysis and discovery of the Sharia ruling. This issue was not raised among the Imamiyyah elders, and has been raised since the time of Mohaqiq Hilli and has been discussed in more detail in contemporary era. This research, by analyzing various arguments and perspectives, has concluded that the arguments based on verse 31 of Surah An-Nur, narrations, consensus, and the Islamic tradition on this issue contain numerous problems. So, the correct view is that there is no objection to a woman’s gaze at a non-mahram man except for the private parts, as long as it is without lustful intent, and the advice to refrain from looking is also a morally acceptable advice and cannot be considered as a jurisprudential ruling. مسئلۀ نگاه به نامحرم از مسائل مهم دینی در عرصۀ اجتماعی است که علم به حکم شرعی آن برای افراد متدین بسیار مهم است. نگاه زن به مرد نامحرم بدون قصد شهوانی هم مانند نگاه مرد به زن نامحرم مسئله‌ای است که نیازمند تحلیل فقهی و کشف حکم شرعی است. این مسئله در میان قدمای امامیه مطرح نبوده، و از زمان محقق حلی طرح شده، و در زمان معاصران نیز به‌طور مفصل‌تر بحث شده است. این تحقیق با تحلیل استدلال‌ها و دیدگاه‌های مختلف به این نتیجه رسیده است که استدلال‌ها ‌به آیۀ 31 نور، روایات، اجماع و سیرۀ متشرعه در این مسئله حاوی اشکالات متعددی است. دیدگاه صحیح این است که نگاه زن به مرد نامحرم به‌جز عورتین چنانچه بدون قصد شهوانی باشد، ایرادی ندارد و توصیه به ترک نگاه نیز به‌عنوان توصیه‌ای اخلاقی پسندیده است و به‌عنوان حکم فقهی نمی‌تواند قلمداد شود. https://flj.isu.ac.ir/article_77721_bd394cbc1607508913005474e24d74e3.pdf
