The diverse functions of dowry have led this tradition to persist over the years. In recent decades, the prevalence of exorbitant and unreasonable dowries and its social harmful consequences have prompted a reexamination of the legal and jurisprudential nature of such dowries. One of the undesirable consequences is the inheritance of the right to claim them, leading to the prolonged existence of the cases related to it for many years. In this article, the mentioned problem has been examined with a descriptive- analytic method.  It appears that solutions based on invalidating unreasonable dowries or relying on evidence indicating the non-inheritance of such rights are not adequate. Hence, as an alternative way, proposing agreements contract like dowry including its positive function but devoid of undesirable consequences is suggested. Such contracts will not addressed to this subject and solve the interpretation of the parties’ intentions, clarify the conditions of mutual consent, and other complex issues around the topic of unreasonable dowries. مهریه یکی از سنت­های اجتماعیِ دارای ریشة شرعی، در جامعة ایران به شمار می­آید. کارکردهای فراوان مهریه موجب شده است این سنت همچنان به بقای خود ادامه دهد. در دهه‌های اخیر، رواج مهریه­هایی با مبلغ هنگفت و نامتعارف و پیامدهای آسیب­رسان اجتماعی آن، موجب بازنگری فقهی و حقوقی ماهیت چنین مهریه­هایی شده است. ازجملة این پیامدهای نامطلوب، به‌ارث‌رسیدن حق مطالبة آن است که موجب بازماندن پرونده­های آن تا سال‌های متمادی است. در این نوشتار مسئلة یادشده با روش توصیفی ـ تحلیلی بررسی شده است. به نظر می­رسد راه‌حل‌های مبتنی‌بر باطل‌دانستن مهریة نامتعارف یا ادلة مبتنی‌بر به‌ارث‌نرسیدن آن، از قوت کافی برخوردار نیستند؛ ازاین‌رو می‌توان به‌عنوان یک راه جایگزین، انعقاد تفاهم­هایی را شبیه به مهریه و با کارکردهای مثبت آن‌ پیشنهاد داد که عاری از پیامدهای نامطلوب آن باشد. چنین قراردادهایی، پیچیدگی­های حقوقی تفسیرِ قصد طرفین در مهریه‌های نامتعارف را برطرف خواهد کرد. https://flj.isu.ac.ir/article_77133_8ac92e3322f8f8f66e8dd18dbb49323a.pdf
