Journal Article 2023 05 22 Pregnancy is a condition in which a woman has a fetus in her womb that lasts for 9 months and ends with childbirth. This period has effects on the mood and psyche of the pregnant woman that has been investigated in the field of obstetrics and gynecology as well as Psychology and can be effective in her criminal and penal sentences. This research, entitled the "studying the effect of pregnancy condition on the criminal sentences of pregnant women in Islamic law and jurisprudence, which has been done by descriptive-analytical method, examined the views of jurists and relevant laws on this scope and concluded If a woman is pregnant, in Islamic jurisprudence and law, the implementation of hudud and Qeṣāṣ is delayed due to the fear and destruction of the fetus, citing verses 33 of Surah Esra and 164 of Surah An'am, narrations and consensus and reason. Pregnancy always causes mood and mental disorders for a woman and causes depression, severe anxiety and impaired concentration, although these matters have no effect in issuance of rules and regulations for her. Due to the reasons for eliminating of criminal responsibility and mitigating factors of crime, pregnancy can reduce criminal responsibility and mitigate punishment for pregnant women. بارداری یا حاملگی وضعیتی است که‏ رحم زن دارای جنین است و مدت زمان نُه ماه به طول می‌انجامد و با زایمان به اتمام می‌رسد. این دوران تأثیراتی بر خلق‌وخو و روان زن باردار دارد که این امر در حوزة علم زنان و زایمان و همچنین روان‌شناسی بررسی می‌شود و به‌تبع، بر احکام جزایی و کیفری او تأثیرگذار است. تحقیق حاضر با عنوان بررسی تأثیر عارضة بارداری بر احکام جزایی زنان باردار در فقه و حقوق اسلامی، به بررسی نظرات فقها و قوانین موضوعه می‌پردازد و با رویکرد توصیفی‌ـ‌تحلیلی به این یافته‏ها می‌رسد که در صورت باردار بودن زن، در فقه و حقوق اسلامی، اجرای حدود و قصاص به‌خاطر بیم از آسیب و هلاک جنین و با استناد به آیات 33 سورة اسرا و 164 سورة انعام و روایات و اجماع و عقل، به تأخیر می‌افتد. دوران بارداری همواره اختلالات خلقی و روانی را برای زن به همراه دارد و افسردگی و اضطراب شدید و اختلال تمرکز را موجب می‏شود؛ البته این مهم در صدور و وضع احکام و قوانین برای او لحاظ نشده است. با توجه به علل رافع مسئولیت کیفری و عوامل مخففة جرم، بارداری می‏تواند باعث کاهش مسئولیت کیفری و تخفیف مجازات برای زن باردار شود. https://flj.isu.ac.ir/article_76725_059e83d6a60903ac8c1b1ec60bf0ccf2.pdf
