This study has been done by collecting library data and with descriptive-analytical method and also by relying on first class Shiite books searched the key words such as embryos, donation, custody and inheritance in them. Due to the attribution of the child to the owners of the sperm, obligatory rights such as custody, alimony and inheritance are established between the child and the owners of the sperm; However, in Article 3 of this law, the legislator has "considered the duties and responsibilities of the couple who received fetus donating and the child born are the parents in terms of maintenance, alimony and respect, such as the duties and responsibilities of the children and the parents." While the child is attributed to donors and does not mention an important issue such as inheritance. Therefore, the law should be change and explain how to assign duties to recipients of fetus. به‌کارگیری روش‏های نوین بارداری مسائل زیادی را در زمینة حقوق طرفین به وجود آورده است که بررسی آثار تکلیفی آن، یکی از آنهاست. هدف این پژوهش فهم آثار فقهیِ تکلیفیِ اهدای جنین براساس نگرش شیعی و رفع ابهام مادة سوم قانون نحوة اهدای جنین به زوجین نابارور است. این مطالعه به‌صورت کتابخانه‌ای و توصیفی ـ تحلیلی و با تکیه بر کتب طراز اول فقه شیعه با واکاوی کلیدواژه‏های جنین، اهدا، نفقه، حضانت و ارث در ادلة معتبر انجام گرفته است. با توجه به انتساب کودک به صاحبان نطفه، حقوق تکلیفی مثل حضانت، نفقه و ارث بین کودک و صاحبان نطفه برقرار است؛ اما قانون‌گذار در مادة سوم این قانون، «وظایف و تکالیف زوجین اهداگیرندة جنین و طفل متولدشده را از لحاظ نگهداری و نفقه و احترام، نظیر وظایف و تکالیف اولاد، پدر و مادر دانسته است»؛ درحالی‌که کودک منتسب به اهداکنندگان است و به موضوع مهمی مثل توارث اشاره نشده است. بنابراین باید قانون تغییر کند و نحوة تعیین وظایف برای گیرندگان اهدا را تبیین نماید. https://flj.isu.ac.ir/article_75932_5c282eec292d416b8051df3a0c5870ef.pdf
