In this situation, the guardianship of children is one of the most important issues. The guardian is sometimes denied from her or his guardianship right. Diseases and illness are one of the most important things that affect on guardianship of children. The most of Islamic jurists believe that chronic and incurable diseases don't cause the loss of guardianship of children if the guardian would be able to do his or her duties through a deputy. In general, it can be said that if the guardian's Infectious disease cause to damage the child's physical health, his or her guardianship right will be revoked. But the principle of his or her guardianship will be survived if the guardian can prevent the spread of the disease to the child and to carry out matters related to child's maintenance and training through the supervisor. جایگاه خانواده در سرپرستی و صیانت کودکان غیر‌قابل‌انکار است. گاهی بنیان خانواده به عللی رو به سستی می‌گراید و بنای آن در هم می‌ریزد و سبب می‌گردد خانواده کارآمدی خود را از دست بدهد. در این وضعیت، حضانت فرزندان یکی از مهم‌ترین مسائلی است که جلوه می‌نماید. در مواقعی، نگهدارنده از حق حضانت خود منع می‌شود. یکی از مهم‌ترین مواردی که بر حضانت اثر می‌گذارد، رخداد بیماری و مرض است. اکثر فقهای اسلامی بیماری‌های مزمن و صعب‌العلاج را موجب سقوط حضانت نمی‌دانند؛ البته این درصورتی است که بیمار بتواند وظایف مربوط به سرپرستی طفل را ازطریق نایب انجام دهد. به‌طور کلی، می‌توان گفت اگر با بیماری مسری سرپرست، صحت جسمانی طفل در معرض خطر قرار بگیرد، حق حضانت وی ساقط می‌شود؛ اما اگر وی بتواند از سرایت بیماری به طفل جلوگیری کند و ازطریق مباشر، امور و مصالح مربوط به نگهداری و تربیت او را انجام دهد (به تعبیر دیگر، بیشتر جنبة مشورتی و مدیریتی داشته باشد)، اصل، بقای حضانت اوست. https://flj.isu.ac.ir/article_75860_be4d7403582645fe41d3921ac8ce530d.pdf
