There has been disagreement among jurists as to the validity or invalidity of the said condition; even among jurists; Some believe in the invalidity of the condition and others believe in its validity; In this article, we study the opinions and theories related to the condition of the wife's not expelling from her Balad and its subdivisions (including the condition of the wife's not expelling from home, drop the condition, the relationship between the condition of the wife's not expelling<strong> </strong>from Balad and the amount of her dowry).Finally, based on jurisprudential and legal opinions and critique of each of the proposed views, the validity of this condition is concluded. It should be noted that this article is an applied article based on its purpose and is descriptive-analytical based on its nature and method. زوجین در عقد نکاح، همانند دو طرف عقود دیگر، می‌توانند خواسته‌های خود را درقالب شرط درآورده، تا حدودی درجة مطلوبیت این عقد را بالا ببرند؛ ولی در مصادیق شروط صحیح ضمن عقد نکاح اختلاف‌نظر وجود دارد و شرط عدم اخراج زوجه از بلد نیز از همین دسته شروط اختلافی است. بدیهی است که مشروطٌ‌لهِ شرط مذکور، زوجه و مشروطٌ‌علیه آن، زوج می‌باشد. درخصوص صحت یا بطلان شرط مذکور خلأ قانونی و حتی بین فقها نیز اختلاف‌نظر وجود دارد. برخی اعتقاد به بطلان شرط و بعضی دیگر اعتقاد به صحت آن دارند. در این جستار، به مطالعة آرا و نظریات مرتبط با شرط عدم اخراج زوجه از بلد و فروعات آن (ازجمله شرط عدم اخراج زوجه از منزل، اسقاط شرط و ارتباط شرط عدم اخراج زوجه از بلد با میزان مهر المسمی) پرداخته و درنهایت با استناد به نظرات فقهی و حقوقی و نقد هریک از دیدگاه‌های مطرح‌شده، صحت شرط مزبور نتیجه‌گیری می‌شود. لازم به ذکر است مقالة حاضر براساس هدف، کاربردی و براساس ماهیت و روش، توصیفی ـ تحلیلی می‌باشد. https://flj.isu.ac.ir/article_75727_b173bfe8b1f873afeb371b9cecc554df.pdf
